Acceptance of Terms: By registering, bidding, or participating in the auction, the bidder acknowledges having read, understood, and agreed to all terms and conditions.

Internet Buyer's Premium: 15%

Participation Requirements:  A valid credit card is required for bidder registration and approval.

Payment Terms:  Payment is due immediately upon conclusion of the auction. Accepted forms of payment include cash, company check (with prior approval), ACH transfer, wire transfer, and major credit cards. A 3% convenience fee will be added to all invoices paid by credit card. This fee may be avoided by payment via ACH, wire transfer, cash, or approved company check. Auctioneer reserves the right, at its sole discretion, to require payment by ACH or wire transfer for any invoice amount or bidder.

Sales Tax: Applicable sales tax will be collected unless the purchaser provides a valid tax exemption certificate acceptable to the Auctioneer prior to invoicing.

Inspection: All items are available for inspection prior to bidding. Bidders are strongly encouraged to inspect items in person. Photographs, descriptions, and other information are provided as a courtesy and are not guaranteed. By placing a bid, the bidder acknowledges that they have had a full and fair opportunity to inspect the property and are relying solely upon their own investigation and judgment.

Condition of Property:  All property is sold STRICTLY "AS IS, WHERE IS," with all faults and without warranty or guarantee of any kind, expressed or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, condition, quality, quantity, suitability, authenticity, title, or usability. Descriptions, photographs, measurements, model numbers, serial numbers, year models, hours, mileage, dimensions, and other information are believed to be accurate but are not guaranteed. Bidders shall rely solely upon their own inspection and investigation.

All sales are final. No refunds, adjustments, exchanges, or chargebacks shall be permitted.

Title: The Seller warrants only such title as Seller may possess. Auctioneer makes no representation or warranty regarding ownership, title, liens, encumbrances, or merchantability.

Auctioneer's Authority: The Auctioneer shall regulate bidding, settle disputes, determine the successful bidder, and may reject nominal or fractional advances deemed detrimental to the auction. In the event of any dispute, clerical error, omission, software malfunction, discrepancy between online bidding and live bidding, or other issue affecting the sale, the Auctioneer's records shall be final and conclusive.

Bid Retraction: Bids may not be withdrawn, retracted, or canceled once submitted. By placing a bid, the bidder enters into a legally binding agreement to purchase the property if declared the successful bidder.

Risk of Loss: Ownership and risk of loss pass to the successful bidder immediately upon the Auctioneer's declaration of "Sold." Thereafter, the purchaser assumes all responsibility and risk for theft, damage, destruction, loss, or deterioration of purchased property, regardless of whether the property has been removed from the auction site.

Removal and Pickup: When selecting PICKUP, bidders must schedule a pickup appointment through the auction software or as otherwise directed by Auctioneer. All items must be removed during the designated pickup period. Any property not removed by the stated deadline may be considered abandoned and may be resold, disposed of, removed, or stored at the purchaser's expense without refund.

Loading and Removal Liability: Purchasers are solely responsible for loading, securing, transportation, and removal of purchased property. Auctioneer, Seller, property owner, and their respective employees, agents, and representatives shall not be responsible for accidents, injuries, damages, losses, or claims arising from inspection, loading, removal, transportation, or use of purchased property.

Shipping: The UPS Store in Taylors, South Carolina, will handle shipping of qualifying smaller lots such as hand tools, battery-powered tools, boxed items, and similar property. Large, heavy, oversized, lengthy, or bulky items will not be shipped and must be picked up by the purchaser or the purchaser's designated carrier. Shipping, handling, packaging, insurance, and transportation charges are the sole responsibility of the purchaser and are separate from the auction invoice.

Default: If the purchaser fails to make payment as required, Auctioneer may, at its sole discretion:

• Charge the credit card on file
• Cancel the sale
• Revoke bidding privileges
• Resell the property
• Retain deposits or payments as liquidated damages
• Pursue legal remedies for damages and collection costs

Purchaser agrees to pay all collection expenses, court costs, attorney fees, and any deficiency resulting from resale of the property. A service charge of 2% per month (24% annually) shall accrue on unpaid balances.

Bidder Information: Bidders must provide accurate and complete registration information, including name, address, telephone number, and email address. Auctioneer reserves the right to refuse registration, suspend bidding privileges, or revoke bidding rights at any time.

Internet Bidding Disclaimer: Internet bidding is offered as a convenience only. Auctioneer shall not be responsible for missed bids, delayed bids, internet interruptions, software malfunctions, hardware failures, connectivity issues, power outages, or any technological failure affecting bidding. The bidder acknowledges that internet service may fail before or during the auction and agrees that Auctioneer shall have no liability for missed bids or bidding errors resulting from such failures.

Malfunction, Shutdown, and Loss of Service: If any malfunction, shutdown, interruption of service, clerical error, software issue, or technological problem affects the auction, Auctioneer reserves the right to reopen bidding, extend bidding, suspend bidding, cancel bids, withdraw lots, resell lots, or otherwise modify the auction in a manner deemed appropriate and in the best interest of the Seller. Auctioneer's decision shall be final.

Force Majeure: Auctioneer reserves the right to postpone, extend, suspend, cancel, or modify the auction due to weather events, acts of God, governmental actions, public emergencies, labor disruptions, technical failures, or circumstances beyond Auctioneer's reasonable control.

Governing Law: These terms shall be governed by the laws of the State of South Carolina. Any dispute arising from the auction shall be brought exclusively in a court of competent jurisdiction located in Greenville County, South Carolina.

Chargebacks and Payment Disputes: 

By registering for the auction and placing bids, the bidder expressly authorizes Meares Property Advisors, Inc. to charge the credit card, ACH account, or other payment method provided for all purchases, buyer's premiums, applicable taxes, shipping charges, convenience fees, and other amounts due under these Terms and Conditions.

The bidder agrees not to initiate a credit card chargeback, ACH reversal, payment dispute, or similar claim for any purchase made in accordance with these Terms and Conditions. Any dispute regarding an item's condition, description, authenticity, quantity, quality, shipping costs, pickup requirements, buyer's remorse, or failure to inspect shall not constitute grounds for a chargeback, ACH reversal, or payment dispute.

In the event a bidder initiates a chargeback, ACH reversal, payment dispute, or other payment recovery action, the bidder shall remain liable for the full purchase price, buyer's premium, taxes, shipping charges, convenience fees, collection costs, attorney's fees, bank fees, processor fees, and all other damages incurred by Meares Property Advisors, Inc. in defending or resolving such action.

The bidder agrees that Meares Property Advisors, Inc. may provide these Terms and Conditions, auction records, invoices, bidding history, photographs, registration information, correspondence, shipping records, and other transaction documentation to the credit card processor, financial institution, payment network, court, collection agency, or other entity involved in resolving any dispute.

Any successful chargeback, ACH reversal, or payment dispute shall constitute a default under these Terms and Conditions and may result in suspension or permanent revocation of bidding privileges.
